𝐀𝐭𝐭𝐞𝐧𝐭𝐢𝐨𝐧 𝐀𝐮𝐬𝐭𝐫𝐚𝐥𝐢𝐚𝐧 𝐞𝐦𝐩𝐥𝐨𝐲𝐞𝐫𝐬 𝐚𝐧𝐝 𝐞𝐦𝐩𝐥𝐨𝐲𝐞𝐞𝐬! 📢 Holiday shutdowns are around the corner, but this year, there are new rules in play. The Fair Work Commission made changes regarding annual leave shutdown provisions. If your business plans to shut down and wants employees to use their paid annual leave during this time, you need to give them 28 days' written notice. But here's the catch: the Commission can't include a provision for unpaid leave during shutdowns. If employees don't have enough leave accrued, it's a bit tricky. Options: 1️⃣ Negotiate provisions in employment contracts. 2️⃣ Let employees take unpaid leave with written agreement. 3️⃣ Make it clear that leave requests will be refused if it depletes leave. 4️⃣ Use RDOs or overtime off instead. 5️⃣ Grant employees with insufficient leave paid leave in advance. When creating your holiday policies, there are many different questions you need to ask, such as... how many days off is an employee entitled to? can they carry over to the next holiday year? and when does the holiday year start? The three most common choices for when a holiday year starts are: 👉 January 1st 👉 The start of the financial year (April) 👉 The anniversary of each employee’s start date In most cases, the date when annual leave resets is the deadline for choosing to carry over holiday days that they haven’t yet used (if this is part of their policy.) Regardless of the size of your business, managing staff leave effectively requires a lot of work, and getting it wrong could mean that you end up short staffed during a busy period, or that you fail to meet your legal obligations in providing adequate time off for your employees.
